Terms
Version 2.4, valid from 23 October 2026
1. Scope
- These terms apply to every order placed on this website. The seller is the artist trading as “Rayski” (“we”). You can reach us through the contact form on this website. The buyer is “you”.
- The version of these terms that is online when you order applies to your order. Other terms, including your own, do not apply unless we agree to them in writing.
- By ordering, you confirm that you have read and accepted these terms.
2. The works
- Originals (“1 of 1”) are unique, hand-made works. Each exists only once.
- Prints are reproductions of the artist's works in A3 format (29.7 × 42 cm), unless the product page states otherwise.
- Originals are signed and come with a certificate of authenticity signed by the artist.
- Photos on this website show the works as accurately as possible. Colours, texture and proportions can look different depending on your screen and on the lighting. These differences are not defects.
- Hand-made works have irregularities, visible strokes, smudges, paper texture and traces of the process. Oil pastel stays soft and never fully dries. These are characteristics of the work, not defects.
3. How a contract is made
- The works on this website are not a binding offer. They are an invitation to order.
- You add works to the cart, choose where it ships and press “Checkout”. Before paying you can review your order, correct your details, and see the total including shipping.
- By completing the payment you make a binding offer to buy. The contract is made when the payment succeeds and we send the confirmation email.
- If a work is no longer available (for example because an original was sold at the same moment), or if a price was clearly wrong because of a technical or typing error, we may cancel the order. In that case we refund the full amount paid, and you have no further claims.
4. Prices, shipping and offers
- All prices are in Swiss francs (CHF). No VAT is charged.
- Shipping costs are extra and are charged on every order. They are shown on the payment page before you pay.
- Deliveries outside Switzerland may be subject to import duties, taxes and customs fees in the destination country. You pay these.
- Discount codes can be entered on the payment page. They are valid only as stated, cannot be exchanged for cash, and cannot be combined unless stated.
- 3 prints for CHF 49: any 3 prints in one order cost CHF 49 together instead of CHF 22 each. Originals are not included. Discount codes are applied on top of the deal price. If you return part of a deal, the refund is the deal price you paid for the returned prints (CHF 49 ÷ 3 each).
5. Payment
- You pay in advance on the payment page of Stripe Payments Europe Ltd. Available methods are shown there (for example card, Apple Pay, Google Pay, TWINT).
- We never see or store your card details.
- We ship only after the full payment has been received.
6. Shipping and risk
- We ship to Switzerland, Liechtenstein and the countries of the European Union, as offered in the cart and on the payment page. Prints are rolled and shipped in a sturdy tube, originals are packed flat and protected. Every parcel is sent with tracking.
- We aim to ship within 5 working days of payment. Delivery times are estimates. A delay does not entitle you to damages. If a work has not been delivered within 30 days of payment, you may cancel the order and get a full refund.
- The risk of loss or damage passes to you when we hand the parcel to the carrier. For consumers in the EU, it passes when you receive the parcel.
- If delivery fails because of a wrong address or because you did not collect the parcel, you pay the cost of sending it again.
7. Checking your delivery
- Check the parcel and the work as soon as you receive it.
- Report visible transport damage or defects by email within 7 days of delivery, with photos of the packaging and the work. Hidden defects must be reported as soon as you discover them.
- If you do not report a defect in time, the work is considered accepted.
8. Defects (warranty)
- If a work is defective and you reported it in time, we will, at our choice, send a replacement print or refund the price after you return the work. Originals cannot be replaced, so we refund them after return.
- Other warranty claims, in particular price reduction and damages, are excluded as far as the law allows.
- Warranty claims expire 2 years after delivery.
- These are not defects: the characteristics listed in section 2; damage caused by improper handling, framing, sunlight, humidity, heat or cleaning; normal wear.
9. Returns
- Swiss law gives no right to cancel or return online purchases. Because every work is made and selected individually, returns are only possible for defects under section 8.
- Right of withdrawal for consumers in the EU. If you are a consumer and your delivery address is in the European Union, you may withdraw from the contract within 14 days without giving any reason. The period ends 14 days after the day on which you, or someone you name other than the carrier, receive the work.
- To withdraw, tell us clearly before the period ends, by email to art@rayski.ch or through the contact form on this website (for example with the model form below). A statement sent in time is enough.
- Send the work back to us without delay, at the latest 14 days after you withdrew. You pay the cost of returning it. You are liable for any loss in value caused by handling the work beyond what is needed to inspect it.
- We refund all payments received from you, including the standard shipping cost, without delay and at the latest 14 days after we receive your withdrawal. We may wait with the refund until the work is back with us or you have shown that you sent it. We use the same payment method you used, and you pay no fees for the refund.
- Model withdrawal form (fill in and send it only if you want to withdraw): "I hereby withdraw from my contract for the purchase of the following work(s): … / Ordered on … / Received on … / Name … / Address … / Date …"
10. Copyright
- All works are protected by copyright. The artist keeps all copyright, including after a sale.
- Buying a work transfers ownership of the physical object only. It does not transfer any copyright or rights of use. This applies to originals as well as prints.
- The artist may continue to make, sell and publish prints and reproductions of every work, including originals that have been sold, and may show them in a portfolio, online, in exhibitions and in publications.
- You may hang and show the work, sell it on, give it away and lend it. You may photograph it and share these photos privately and on social media if you credit the artist (“Rayski”).
- Without written permission you may not: make copies, scans or prints; sell reproductions; use the work on products or merchandise; use it for advertising; create NFTs or other digital editions; use it to train AI models; or alter it and present the result as a work by the artist.
- The artist's moral rights remain unaffected, including the right to be named as author and the right to access the work to reproduce it.
11. Liability
- We are liable without limitation for intent and gross negligence and for personal injury.
- In all other cases our liability is excluded as far as the law allows, in particular for indirect damage, consequential damage and lost profit.
- Our total liability per order is limited to the amount you paid for that order.
- We are not liable for delays or failures caused by events outside our control, such as strikes, postal disruptions, illness, natural events or official measures.
12. Privacy
We handle your personal data as described in the privacy policy below.
13. Final provisions
- Swiss law applies. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
- The place of jurisdiction is Basel, Switzerland. Consumers may also sue, and must be sued, at their place of residence. Mandatory consumer protection rules of your country of residence remain unaffected.
- If any part of these terms is invalid, the rest remains valid. The invalid part is replaced by the valid rule that comes closest to its purpose.
- We may change these terms at any time. Changes do not affect orders already placed.

Your rights
You can ask what data we hold about you, and ask us to correct or delete it, unless the law requires us to keep it. Use the contact form on this website. You can also complain to the Federal Data Protection and Information Commissioner (FDPIC).
